Meridian Economics has submitted comments on NERSA’s public notice on Eskom’s request to amend its negotiated pricing agreements (NPAs) with Samancor Chrome Limited and Glencore-Merafe Chrome Venture. We note that while these amendments will impact all electricity users and taxpayers, NERSA’s Consultation Document leaves out almost all the key details needed to assess the deals. Without this information, the public cannot provide meaningful input, which undermines the fairness of the process and could leave any resulting decision open to court challenge or reversal. We therefore recommend that NERSA publish versions of Eskom’s application and the proposed agreements with minimal redactions, and run a fuller public process that gives stakeholders enough information to participate meaningfully.
